WITH
GE MONEY WARRANTY SERVICES
CADA F&I
Resource Center is proud to announce a new Colorado
exclusive partnership
which began on May 31, 2007 with one
of the industry’s most respected and secure providers: GE
Money Warranty Services.

The CADA Board of Directors made a
unanimous decision to go with GE after an extensive formal
nationwide search, with request for proposal and evaluation
process that included
17 of the strongest and most respected
vehicle service contract and F&I related product providers
available today. Using the same tact as a dealer principal
or key decision-maker, CADA researched, investigated and
analyzed critical areas to success when developing a
long-term and profitable VSC/ESC partnership.
There
are certain steps a dealer should take and many areas to
consider before entering
into any product relationship. CADA
carefully took necessary time for a detailed review
regarding the 17 VSC
companies interested in an endorsement.
After
narrowing the choices, five finalists provided member dealers
and staff with formal presentations. During these
presentations, we focused on key areas:

Automotive industry experience: Does the company
specialize in our
market-place and have full
understanding of our specific member dealer
needs?
-
Overall strength: All A.M. Best ratings where
examined and had to be
more than an A rating for
consideration.
-
Stability and solvency: Business longevity,
transparency of rating and
assets protection, as well as
comparison to manufacturer insurance
protection.
-
Compliance: The concern for proper disclosure, as
well as consistent
business practices must be of high
importance.
-
Products: Multiple term and coverage offerings,
exclusions as well as
side-by-side comparison to
manufacturer coverage’s and benefits were
considered.
-
Claims administration: Process-driven, yet
customer-focused staff with
ASE and strong service
experience.
-
Price: Selection of partnership or representation
should never be based
on price alone, yet having
flexibility in this area is key to dealer success
and
profit potential.
-
Profit participation: Reinsurance (CFC & NCFC) as
well as Retro’s with
transparent fees and returns.
-
Risk profile:
No current or prior Risk Retention Groups (RRG) where
part
of the CADA formal RFP process.
-
Technology: Companies must be able to flex to our
fast moving industry,
while still providing the highest
levels of service today and focusing on the
innovations of tomorrow.
-
Long term goals and initiatives: With the
environmental, consumer and
industry concerns of recent
years, a company must have a plan-of-action
to grow and make opportunities available to all dealers.

SALESPERSON AND DEALERSHIP BONDS
TO INCREASE JULY 1
The
Colorado General Assembly recently passed Senate Bill 211, and
Gov. Ritter
has
signed the legislation into law, initiating the first
increase in sales person and dealership
bond amounts in more
than 20 years.
This
increase represents a compromise between various industry
segments and
was supported by Colorado's new car franchise
dealers through CADA. It was
determined by the CADA Legislative
Policy Committee members that the best way to protect consumers
from under-capitalized dealers was to increase the bond
amount
required to obtain and keep a dealer license.

The best time to
concentrate on your political agenda and strategy is during the off
season.
The
time between legislative sessions is frequently the only time when the
pace of
politics slows enough to get a quick look at where issues may be heading.
This
time is precious as
it allows candidates, both for incumbents and those
preparing to run for office, to organize
their campaigns and raise the
appropriate amount of money.
It is during these summer
months that many legislative members begin raising money for
the upcoming
election cycle. During the past election, CADA
strategically and successfully contributed to a wide variety of candidates. Contributions from CADA members helped maintain our legislative presence and convey
the position of auto dealers across the state on important issues to a vast array of legislators. In fact, more than
90% of our contributions went to winning candidates.

REMINDERS ON
APPROPRIATE USES OF DEALER FULL USE AND DEMO PLATES
Periodically, CADA reminds dealers of
the limitations covering both full use and demo plates.
Full Use Plates
The key statutory provisions regarding how full plates can be used are
below:
42-3-116(6), part (c)
-
Full-use dealer plates may be used only for
vehicles owned and offered for sale
by the dealer or wholesaler.
-
Full-use dealer plates
shall
not be used on vehicles owned by dealerships or
wholesalers that are commonly used by that dealer as
tow trucks or vehicles
commonly
used by that dealer to pick up or
deliver parts.
-
At the dealer's or wholesaler's discretion, the full-use plate
may be transferred from
one motor vehicle to another motor vehicle. The
dealer or wholesaler shall not be required to report any such transfer
to the department.
42-3-116(6), part (d)
A motor vehicle dealer or wholesaler may
assign a full-use dealer plate only to the following persons:
-
Owners or co-owners
of the licensed dealership or wholesale motor vehicle
business;
-
An employee of the motor vehicle dealer or wholesaler;
-
To any person, including former, current, and prospective
customers, in order to
serve the
legitimate business interest
of the motor vehicle dealership or motor
vehicle wholesale business; and
-
A spouse or dependent child living in the same household as the
licensed dealer
or wholesaler.

Demo Plates
Demo plates are much more restrictive than dealer full-use plates. Key
highlights of the regulations regarding the use of demo plates
are below:
-
A dealer demonstration plate can be
displayed ONLY on vehicles owned by or consigned to the dealer or
the wholesaler.
-
A dealer demo plate may be used on
a vehicle operated by a prospective buyer. Demonstration drives
by a prospective purchaser cannot exceed seven (7) calendar days.
The dealer must issue an authorization letter to any prospective buyer
demo-driving the vehicle after the dealer's NORMAL business hours on day
one. [The regulation also indicates what must be included in the
letter; see attached]. The customer must keep the authorization
letter in the vehicle at all times and present it to a law enforcement
officer upon request.
-
A prospective buyer may use a
dealer demo plate with a dealership employee in the vehicle during the
dealer's NORMAL business hours.
-
A dealership employee, during NORMAL
business hours of the dealership, may use a dealer demo plate for
conducting legitimate dealership business.
-
A dealer demo plate may not be
used on any vehicle that has been sold and is in the possession of
the purchaser, or upon any vehicle leased or rented by such dealer.
-
A dealer demo plate may not be
used on vehicles that are being delivered to the purchaser.
-
Owners and employees of the dealer
may not operate a demo-plated vehicle for their private
purposes or use a demo plate on any commercial vehicle.
-
Demo plates may not be
displayed on any of the following vehicles owned by the dealer:

tow vehicles, ● parts pickup/delivery vehicles, ● service department loaners,
● courtesy shuttle vehicles, ● rental vehicles, ● haulers, or
● any vehicle bearing the dealer's name or advertisement (other than
the small
dealer badge normally affixed to the rear of the vehicle,
or the license plate
holder bearing the dealer's name).
Such vehicles shall be titled and
registered in the name of the dealership.

COLORADO AND "BEST PRACTICES" SUMMARY AVAILABLE
As a reminder, KPA is a CADA-endorsed
provider, offering dealership-specific compliance and employee safety
services for environmental regulation, OSHA, Department of
Transportation handling requirements, employee safety, and hazardous
materials handling. In 2006, KPA completed a re-organization and
relocated their corporate headquarters to the Denver metro area and are
now based in Lafayette, Colorado. CEO Vane Clayton presented to the CADA
Board of Directors earlier this month, indicating a strong focus on
Colorado, its new home state.
