EMPLOYERS BEWARE! FOUR ANTI-BUSINESS INITIATIVES ARE ON THE COLORADO BALLOT. YOUR BUSINESS IS THREATENED!! WHAT CAN YOU DO?
We hope we have your attention!! This year's election is critical to Colorado employers. Our state faces four anti-business, union-sponsored ballot initiatives that will create unprecedented negative changes in the laws governing the Colorado workplace:
- Just cause for suspension or discharge of employees
- Additional employee lawsuits for workplace injuries
- Mandatory healthcare coverage paid for by employers
- Criminal liability for executive officials

Employers must take immediate action because absentee ballots go out in early October and votes will be cast soon.

REMINDER: NEW FEDERAL RED FLAGS & ADDRESS DISCREPANCY RULES: COMPLIANCE DEADLINE IS NOVEMBER 1st
A reminder that the mandatory compliance deadline for the new, federal Red Flags rule is now one month away—November 1st, 2008. All dealerships should be taking the necessary steps to implement a program. 
Under the new federal "Red Flags Rule," dealerships and other creditors must develop and implement a comprehensive Identity Theft Prevention Program. The idea behind this law is to ensure policies and procedures are in place to detect and prevent ID Theft before it occurs. Note that because it is the dealership’s responsibility to verify a consumer’s identity, an ID Theft occurrence is typically the dealership’s responsibility under most lender agreements. Dealerships who are victims of ID Theft can be on the hook to pay off the lender, and left trying to collect from their insurer for the loss. This new federal requirement can also help you prevent and avoid such costly occurrences.

NADA ‘s “A Dealer Guide to the FTC Red Flags and Address Discrepancy Rules: Protecting Against Identity Theft”
To assist with compliance, NADA has issued a compliance guide. The guide explains the requirements under the new Rules, and includes detailed, step-by-step guidance on developing the written program required under the Red Flags Rule, as well as a sample written program, worksheets, and other helpful materials. All NADA members were mailed one free copy of the full guide.
- Note: The sample written program (Section Two) from NADA’s guide is available in MS Word files to aid dealers in developing written programs specific to their dealerships. These materials are available free to NADA members upon request. To receive these materials, contact me@nada.org with your request and member identification number.

Colorado Automobile Dealers Association Members Profit Through Risk Management 
The Designated Risk Manager Training Program was developed to target specific risk management concerns for the auto dealer industry. Companies that are the most successful controlling losses have designated a key person as their risk manager. This person is supported by top management and is both responsible and accountable for identifying loss exposures and implementing risk management solutions.
Through CADA’s partnership with Federated Insurance, there is no charge to attend this training and you do not have to be a current Federated client. Attendees, however, are responsible for air and ground transportation to and from Owatonna, Minnesota, and lodging in Owatonna.
