SESSION DESCRIPTION: "Rescuing Service Profits" will educate dealers on the current service landscape and uncover how dealers are losing ground to independent service shops and chains. Based on findings from recent research studies, Jack Simmons will show dealers how to reverse this trend and get customers back in the dealership service lanes to increase their revenue and profits. This session will detail the amount of service revenue opportunities dealers are losing out on, why consumers are going to competitors, and then provides solutions to help dealers win back service market share. One key area of focus includes how to best engage Millennials in this arena. Owners, GMs, and Service Managers will be able get actionable takeaways from this presentation that they can immediately apply to their operations. 

BIO: Jack Simmons is a Dealer Training Manager at Cars.com. Prior to joining Cars.com, Simmons served as the Vice President of Automotive Solutions for WorldNow, where he was the primary architect behind the company’s automotive vertical. Simmons also has served as a National Dealer Trainer for AutoTrader.com, where he managed and developed training programs for dealers, manufacturers and state automotive associations. 
Jack has more than 25 years of automotive industry experience and has trained 96,000 automotive professionals during his career. He has spoken before NADA Dealer 20 Groups and has served as a workshop presenter at numerous industry events, including NADA, NIADA and national BHPH conferences.


 

T.J. WARD OF THE DENVER BRONCOS JOINS LOCAL JAZZ LEGEND HAZEL MILLER AND THE HAZEL MILLER BAND FOR A STAR STUDDED NIGHT


CADA is pleased to announce that 2-time Pro Bowler and Denver Broncos safety T.J. Ward has been named the 2015 VIP Chair of the Charity Preview Party. Ward is a fifth-year player who started all 54 games played during his first four seasons with Cleveland and joined the Broncos on March 11, 2014. DENVER AUTO SHOW INDUSTRY NIGHT

The Colorado Automobile Dealers Association (CADA) is proud to present the 2015 Denver Auto Show. The five-day show opens to the public on Wednesday, April 8th and runs through Sunday, April 12th. On Friday, April 10, 2015, from 5 pm – 10 pm, CADA is pleased to once again offer “Industry Night” for all dealership employees. Industry Night allows each employee to bring two guests and/or immediate family members (two adults and three children maximum) to enjoy the auto show free of charge. CADA is sending promotional posters and a sample employee verification letter to each store in the state this week, so be on the look out for these materials in the next few days.

For free admittance, please present the following at the Exhibitor Check-In Desk (Upper F Lobby outside the show entrance): 

  • An original letter on dealership letterhead verifying employment. A separate verification letter is needed for each employee. 
  • A photo I.D. 

Please note that Industry Night is the only night dealership personnel are admitted free of charge to the show. They will be charged general admission prices at all other times.

NADA 60-second Email

The U.S. Department of Labor (DOL) has revised the definition of "spouse" under the federal Family and Medical Leave Act (FMLA). Effective March 27, eligible employees seeking to take unpaid, job-protected leave to care for a spouse (or certain family members related by marriage) with a serious health condition, for exigency leave related to a spouse's military service, or for military caregiver leave, may claim a same-sex, common law, or foreign-celebrated marriage (if valid under any state law). The new DOL rule also states that the validity of a spousal relationship is based on the law of the place-of-celebration, not the law where the employee resides (or is employed).  
 
Language in the preamble to the new DOL rule seems to suggest that an eligible employee seeking FMLA leave need only allege the existence of a spousal relationship, and that employers may not require proof or documentation of such. This runs directly counter to existing regulatory language, and to DOL Forms WH-381 and WH-382, which contemplate that employees seeking leave provide sufficient documentation to establish a spousal relationship.  Moreover, the preamble seems to suggest that employers are presumed to know the marriage laws for all potential "places-of-celebration."  

Dealers should revise their leave policies to accommodate the new definition of "spouse," should educate employees about the new definition and its potential impact on FMLA leave requests, and to attempt to administer the FMLA rules equally and fairly with respect to all eligible employees.  In addition, dealers should pay close attention to any state law mandates that vary form the federal scheme.

NADA SUPPORTS BIPARTISAN EFFORT TO REFORM CFPB AUTO LENDING GUIDANCE
  
NADA is urging Congress to pass HR 5403, a bipartisan bill that nullifies the Consumer Financial Protection Bureau's (CFPB) flawed guidance on auto lending and requires more transparency and accountability from the agency on future guidance.

The new bill, "Reforming CFPB Indirect Auto Financing Guidance Act," would allow the agency to reissue its guidance under a more transparent process.

As previously reported by NADA, in March 2013, the CFPB issued guidance that threatens to eliminate the flexibility of new-car dealerships to discount the interest rate offered to consumers to finance vehicle purchases. The CFPB claims that negotiated interest rates between dealers and their customers create a significant risk of unintentional "disparate impact" discrimination. However, there are a variety of legitimate business-related factors that can affect finance rates, such as beating a competing rate.

"HR 5403 is needed because it requires the CFPB to follow a transparent process when issuing auto finance guidance," said NADA Chairman Forrest McConnell. "The bill would rescind the 2013 auto finance guidance and require public participation for future guidance before it is issued."

NADA urges dealers to contact their House members today to co-sponsor HR 5403.
